Terms of Service

These Terms of Service ("Terms") govern your use of the website at jmann.me (the "Website") and any software application published by Jess Mann ("I", "me", "my") that links to these Terms (each an "Application", and together with the Website, the "Services"). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

The Website is an informational site about me and my work. Applications are tools I build, some of which connect to third-party services such as Google APIs at your direction. I may change, suspend or discontinue any part of the Services at any time without notice.

Subject to these Terms, I grant you a limited, non-exclusive, non-transferable, revocable license to use the Applications for your own lawful purposes.

Where an Application's source code is published under an open-source license, that license governs your rights to use, copy, modify and distribute the code, and controls if it conflicts with these Terms.

You agree not to:

• use the Services in violation of any applicable law or regulation;
• access accounts or data that you are not authorized to access;
• attempt to probe, scan, disrupt or overload the Services or their infrastructure;
• use the Services to transmit malware, spam or other harmful content; or
• misrepresent your affiliation with me or use my name to imply endorsement.

Applications that connect to Google or other providers rely on those providers' services, which are subject to their own terms, including the Google Terms of Service. You are responsible for complying with those terms. I am not responsible for the availability, accuracy or practices of third-party services.

How Applications handle data from those services is described in the Privacy Policy.

Except for open-source code and third-party trademarks, the content of the Website, including text, design and graphics, is owned by me and protected by copyright and other laws. You may share links to the Website, but may not copy or republish its content without permission. Third-party names and logos belong to their respective owners.

The Services are provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and that the Services will be uninterrupted, secure or error-free. You use the Services at your own risk and are responsible for keeping backups of your data.

To the fullest extent permitted by law, I will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits, revenue or goodwill, arising out of or related to your use of or inability to use the Services, even if advised of the possibility of such damages. My total liability for any claim relating to the Services will not exceed the greater of the amount you paid me for the Services in the previous twelve months or USD $50. Nothing in these Terms limits liability that cannot be limited under applicable law.

You agree to indemnify and hold me harmless from any claims, losses or expenses, including reasonable legal fees, arising from your misuse of the Services or your violation of these Terms.

I may suspend or end your access to the Services at any time if you violate these Terms. You may stop using the Services at any time, and may revoke an Application's access to your Google account from your Google Account permissions page. Sections that by their nature should survive termination will survive.

These Terms are governed by the laws of the place where I reside, without regard to its conflict-of-law rules. If you are a consumer, you also keep the protection of any mandatory laws of the country where you live, and nothing in these Terms affects your statutory rights.

I may revise these Terms from time to time. The effective date at the top of this page shows when they were last updated. Continuing to use the Services after a change means you accept the revised Terms.

These Terms, together with the Privacy Policy, are the entire agreement between you and me about the Services. If any provision is found unenforceable, the rest remain in effect. My failure to enforce a provision is not a waiver of it. You may not assign these Terms without my consent.
